n 本周稀土市场金属铽价格有所下跌，镨钕、镝铁价格相对稳定。亚洲金属网价格:镨钕金属331-336元/KG，镝铁合金价格1250-1280元/KG，铽金属价格3100-3200元/KG。

This weekend Tb price decrease slightly, while the price of PrNd and DyFe keeps relatively stable. Prices from Asian Metal present: PrNd 331-336 RMB/KG, DyFe 1250-1280 RMB/KG, Tb 3100-3200 RMB/KG.

n 根据国土部下达江西省的指标，一批稀土矿（稀土氧化物REO）离子型稀土矿开采总量指标为4500吨（全国8950吨）。

According to the quota that Ministry gives to Jiangxi Province, the total mining volume of the first batch of rare earth mine (rare earth oxide) ion-absorbed rare earth mine is 4500 tons (total mining volume in China is 8950 tons )

近日，中国稀土企业在一场已耗时17个月之久的知识产权“遭遇战"中取得了阶段性胜利：针对日本日立金属株式会社的2件稀土产业核心技术的美国，美国商标局审判和上诉委员会裁定前述中涉诉的全部权利要求无效。

Recently the Chinese rare earth enterprises achieved a phased victory after a intellectual property rights battle last in 17 months which is about two rare earth industry core technologies of Hitachi Metals, Ltd. on its U.S. Patent. The United States Patent and Trademark Office (USPTO) and its Patent Trial and Appeal Board (PTAB) have made the final written decisions and determined that every claim challenged by the Alliance was invalid. The rare earth industry was cheered by this good news.

作为世界上稀土储量丰富的国家，中国稀土产业在发展之初，曾经试图走出一条“资源换技术"的发展之路，而在这场“遭遇战"中，中国企业正是深刻意识到了要抛弃“资源大户"的盲目自信，而后经过聘请国内外的技术和反垄断法分析，才发现了日立金属生产技术并未有革命性的创新的问题。在掌握了日立金属涉嫌违反法及反不正当竞争法和反垄断的相关规定后，中国企业果断出击、双管齐下，一方面在份额大的美国市场提起对方权的无效宣告请求，另一方面在国内起诉对方搭售以及拒绝许可滥用市场支配地位垄断侵权，合理的知识产权诉讼策略帮助中国企业取得了阶段性胜利。

As one of the most abundant country in rare earth reserves in the world, at the beginning of industry development, we tried to develop based on "trade resources for technology", but after that, we certainly realized that we need abandoned the overconfidence of being a abundant resource country. Then we hired the top technical experts and antitrust law experts to analyze and found out that the production technology of Hitachi Metals do not have revolutionary innovation. After we got the proof of being suspected in violating the patent law, anti-unfair competition law and antitrust law, the Chinese companies acted fast on two sides, one is requested a lawsuit in the largest share US market for the invalided of patent rights; on the other hand, requested a lawsuit in domestic for tied sales and use the dominant market position in monopoly infringement. Eventually the reasonable intellectual property litigation strategy helps the Chinese enterprises achieve the phased victory.

业内人士认为，当前，我国需要做好的就是稀土深加工产业规划，从提升整条稀土产业链的自主创新能力出发，制定全国稀土行业的知识产战略，支持相关企业开拓国际市场，提交国际申请，大幅增加稀土推广应用专项资金，并妥善做好“走出去"的侵权预警和海外维权援助工作。这场知识产权“遭遇战"或许只是“反攻"的开端，未来稀土产业的发展，必定还将经历一系列“硬仗"，敢打敢赢，还是要靠知识产权。

Start from the independent innovation ability of rare earth industry chain and make the intellectual property strategy of national rare earth industry, support relevant enterprises to exploit the international market, submit the international patent applications and increase significantly special funds in rare earth patents popularization and applications, as well as properly prepare for the "go out" patent infringement warning and overseas rights aid work.
